Terms & Conditions

I. Initial provisions

1. These terms and conditions apply to the purchase made in the following online shop: www.aartgalery.cz and specify the rights and obligations of the seller and the buyer.

2. The seller and operator/entrepreneur/user/practitioner/keeper of the online shop www.aartgalery.cz is:

II. Sales agreement

 

1. All orders placed through the online shop www.aartgalery.cz are considered binding. By placing an order, the buyer confirms that they are familiar with the current terms of trade and return policy and agree to them.

2. Data provided by the buyer must be truthful and accurate.

3. The electronic order form completed by the buyer is a draft contract. The purchase contract is made upon the acceptance of the order by the seller. 

4. Place of delivery is the address specified by the buyer in the order form.

5. Property right to the goods passes to the buyer after the payment of the purchase price and takeover of the goods by the buyer.

6. The buyer agrees to collect the goods specified in the order, pay the full amount, and, in case of failure to collect the goods in a timely manner, they must pay a storage fee of CZK 100 per head per day and other fees (postage costs, packing, cash on delivery) specified in the order.   

7. If the buyer fails to meet their obligation to collect and pay for the ordered goods, the seller has the right to refuse further orders of this specific buyer.

8. By completing the registration form or purchase order, the buyer gives the seller consent to the collection and archiving of the personal data of the buyer and their purchases. The seller may use these data only in terms of applicable regulations for ensuring administration and accounting of the business. 

III. Shipping date and terms of delivery

 Ordered goods will be sent by Czech Post.

 Unless otherwise specified in the product description, the goods are usually shipped the next business day after the purchase order is received.

IV. Return of the goods

 Any complaints will be handled in accordance with the complaints/return policy of the online shop www.aartgalery.cz and regulations in force in the Czech Republic at the time of the conclusion of the contract.

V. Withdrawal from the contract – return of goods

 Under the paragraph 6 of Civil Code N. 367/2000, the buyer has the right to withdraw from the contract within 14 days after collecting the goods. If they so decide, the undamaged goods must be returned (in undamaged packaging), without signs of use or wear, in original package, within disclosed period (determined by the shipping date). Goods cannot be returned on delivery. Upon receiving the returned goods, the buyer is entitled to a full refund in a manner specified in a previous agreement. The shipping fees are not refundable.

VI. Withdrawal from the contract by the seller, the right to change prices

1. The seller reserves the right to cancel the purchase order or its part in the following cases:

1. goods are no longer manufactured or supplied

2. the price has significantly changed

 

In such cases, the buyer is immediately contacted and any further steps will be negotiated. If the buyer has already paid part or full amount of the purchase price, it will be refunded. 

2. The seller reserves the right to change the prices. Valid prices are confirmed to the buyer at the time of the confirmation of the purchase order. If the valid price is identical or lower than the price on the purchase order, the goods are delivered for the price valid at the time of receipt of the order. If the price is higher than the price on the purchase order, the seller immediately informs the buyer about this fact. 

VII. Final provisions

 Through passing of the order, the buyer accepts outright the price of the goods, delivery conditions and all the provisions of the terms of trade in force at the date of the passing of the order, as well as at the date of the dispatch of the ordered goods.   

 The participants explicitly agree, within the meaning of the provision § 262 paragraph 1 of the Commercial Code, that unless the conditions are explicitly stated otherwise, their rights and obligation conform to the law of the Czech Republic. 

Return policy

If there is a reason for complaint regarding the goods supplied by the internet shop www.aartgalery.cz, the buyer can lodge the complaint by e-mail.

2. The buyer issues a written notice of detected defects to the e-mail address: barazi@email.cz. The notice of defects must contain: name of the buyer, address, telephone number, e-mail (if available), order number, detailed description of the defect and a proposal regarding how to solve the situation.  In all cases, the buyer must submit a copy of the invoice and a proof of payment and delivery of the goods whose defects are claimed. 

3. Before the confirmation of the/Before accepting the goods from the transporter, the buyer is obliged to check if the article carries any signs of damage caused by shipping. If the package is damaged, the buyer is obliged to continue on-site inspection for any damage on goods in the package. The buyers are obliged to immediately inform the transporter and the seller about any eventual damage, in a period no longer than two working days from the date of collection of the goods.
 

Caution:

1. In case of the damaged package, write together with the transporter immediately a report concerning the damage of the article. This will facilitate further processing of the claim.

2. The seller notifies the buyer in three working days after receiving the notification of the defects on subsequent complaint procedure.

3. The seller assumes no liability for damages resulting from using the product, functions and damage caused by improper use of the product, as well as damages caused by external cases. No warranty applies on defects of such nature.
